Dilapidations

Whether you are a Landlord or a Tenant, the chances are one day you will be involved in a dilapidations claim, which brings with it the minefield that is Landlord and Tenant law.

England and Co. has extensive experience in preparing and defending dilapidations claims, along with drafting dilapidations assessments and interim schedules. We take a commercial yet pragmatic approach to ensure the negotiations are concluded swiftly and with the best possible outcome.

License to alter

As a Landlord your primary concern is safeguarding your investment. Tenants invariably need to alter the property to suit their specific business needs, from installing partitioning and office space to structural alterations for process machinery. These changes are dealt with via a Licence to Alter – a legal document typically appending the lease, giving the Tenant permission to carry out the alterations.

England and Co. as part of this process can review the Tenant’s proposals and provide a detailed understanding of what these proposals entail. We advise the Landlord of their suitability, their effect on the greater building and ensure that statutory requirements are met such as applying for planning and building control permission. Once the works are on site, we can offer a monitoring service to ensure that the works being carried out in accordance with the Licence for Alterations, to a good standard, and in- line with health and safety requirements.

Lease plans

All modern leases contain a plan of the subject property, highlighting the extent of the premises being demised. England and Co. is able to provide Land Registry compliant lease plans using the latest version of CAD software.

Schedule of condition

Are you a tenant taking new space, and is this space not in pristine condition? Then how will you prove that the property was not in full repair come the end of the lease when the Landlord presents you with a terminal schedule of dilapidations?

England and Co. can prepare a descriptive and photographic Schedule of Condition detailing the exact condition of the property prior to lease commencement. This can then be appended to the lease and provide you with a source of defence against any future dilapidations claim.
